          เมื่อวันที่ 8 มีนาคม 2566 กรมยุโรป กระทรวงการต่างประเทศและศูนย์ศึกษาการต่างประเทศ ได้ร่วมจัดการสัมมนาเพื่อแลกเปลี่ยนข้อคิดเห็นกับผู้มีส่วนได้ส่วนเสียของร่างกรอบความตกลงว่าด้วยความเป็นหุ้นส่วนและความร่วมมือรอบด้านไทย-อียู (Thailand-EU Comprehensive Partnership and Cooperation Agreement: TH-EU PCA) ในหัวข้อ “ค่านิยมพื้นฐานและความร่วมมือภายใต้ PCA” โดยมีผู้เข้าร่วมจากหน่วยงานภาครัฐ ฝ่ายนิติบัญญัติ ภาคเอกชน ภาควิชาการ และภาคประชาสังคมกว่า 70 คน จากกว่า 30 หน่วยงาน และมีผู้ร่วมอภิปรายจากหลากหลายภาคส่วน เช่น รองประธานคณะกรรมาธิการการต่างประเทศ วุฒิสภา ผู้อำนวยการศูนย์ศึกษาการต่างประเทศ รองอธิบดีกรมยุโรป รองคณบดีคณะรัฐศาสตร์ จุฬาฯ ผู้จัดการโครงการมูลนิธิฟรีดริช เนามัน สำนักงานประเทศไทย ผู้แทนสำนักงานสภาความมั่นคงแห่งชาติ และกระทรวงยุติธรรม

          ในช่วงเปิดการสัมมนาฯ นายอสิ ม้ามณี อธิบดีกรมยุโรป ได้กล่าวย้ำถึงความสำคัญของค่านิยมพื้นฐานในร่าง PCA ไทย-อียู ต่อการดำเนินความสัมพันธ์กับอียูอันจะนำมาซึ่งประโยชน์ต่อไทยอย่างรอบด้าน ในโอกาสนี้ อธิบดีกรมยุโรปได้เปิดตัว website tab อันใหม่บนหน้าเว็บไซต์กรมยุโรป https://europetouch.mfa.go.th ซึ่งได้รวบรวมข้อมูลเกี่ยวกับร่างกรอบความตกลง PCA ไทย-อียู เพื่อให้สาธารณชนสามารถเข้าไปศึกษาข้อมูลและให้ความคิดเห็นต่อร่าง PCA ไทย-อียูได้

           ในช่วงการอภิปราย ที่ประชุมได้ตระหนักถึงความสำคัญของการยึดมั่นในค่านิยมพื้นฐานอันเป็นองค์ประกอบสำคัญของความร่วมมือไทย-อียูภายใต้ PCA อาทิ หลักการประชาธิปไตย สิทธิและเสรีภาพ หลักนิติธรรม ซึ่งจะเป็นกุญแจที่จะนำไปสู่ความร่วมมือกับอียูในด้านอื่น ๆ ต่อไป ค่านิยมเหล่านี้เป็นสิ่งที่อียูยึดถือโดยปรากฏในสนธิสัญญาและปฏิญญาต่าง ๆ ของอียู เป็นสิ่งที่อียูส่งเสริมในการดำเนินโยบายต่างประเทศ โดยเป็นมาตรฐานสากลด้วย บริบทโลกที่เปลี่ยนไปทั้งการทวนกระแสโลกาภิวัตน์ (deglobalisation) และการแยกขั้วอำนาจ ทำให้อียูเร่งที่จะกระชับความสัมพันธ์กับประเทศที่ยึดถือคุณค่าชุดเดียวกัน โดยร่าง PCA เป็นหนึ่งในเครื่องมือนั้น การเจรจาร่าง PCA ถือเป็นการเดินหมากทางยุทธศาสตร์ที่ดีของไทย และไทยก็ได้ประโยชน์ด้วยจากความร่วมมือในประเด็นที่หลากหลายและทันสมัย รวมถึงในประเด็นท้าทายระดับโลกต่าง ๆ ที่ต้องอาศัยการแลกเปลี่ยนองค์ความรู้และแนวปฏิบัติที่เป็นเลิศระหว่างกันเพื่อรับมือ ในมุมมองทางกฎหมาย ไทยและอียูเจรจากันอย่างเท่าทัน อยู่ภายใต้กรอบกฎหมายของไทย การมี PCA นี้ ทำให้ไทยมีมาตรวัดการดำเนินการต่าง ๆ เพื่อให้ทัดเทียมกับความเป็นสากล และความร่วมมือในร่าง PCA ไทย-อียูเป็นโอกาสทางการค้า รวมถึงเป็นทางเลือกทางนโนยบายต่างประเทศของไทยด้วย

          ในการปฏิบัติตามร่าง PCA ไทย-อียู ผู้อภิปรายมองว่า เป็นโอกาสให้ไทยได้เรียนรู้ประเด็นใหม่ ๆ ซึ่งอาจสามารถกลายเป็นประเด็นทางความมั่นคงได้ ไทยจะได้เรียนรู้วิธีคิดของอียูที่แต่ละประเด็นที่เชื่อมโยงกัน รวมถึงใช้โอกาสนี้ในการแสวงหาประโยชน์จากนโยบายมุ่งอินโด-แปซิฟิกของอียู ในด้านการคุ้มครองสิทธิฯ การมีช่องทางหารือกับอียูจะเป็นโอกาสให้อียูมีความเข้าใจเกี่ยวกับบริบทของไทย ในขณะเดียวกัน ไทยก็ได้เรียนรู้จากอียูและประเทศสมาชิกเพิ่มขึ้นด้วย ความร่วมมือด้านธุรกิจกับสิทธิมนุษยชนจะช่วยให้ SMEs มีความตระหนักรู้เรื่องนี้และสามารถแข่งขันได้ในระดับสากล เป็นโอกาสในการของบประมาณของฝ่ายไทยด้วย ในด้านอาวุธ ไทยจะสามารถเข้าถึงข่าวกรองของฝ่ายอียู ได้รับความช่วยเหลือในด้านการบังคับใช้กฎหมาย เข้าถึงเทคโนโลยีใหม่ ๆ และการเสริมสร้างขีดความสามารถ

          ที่ประชุมได้แลกเปลี่ยนเกี่ยวกับข้อท้าทายของไทยในการร่วมมือกับอียู โดยไทยต้องเน้นการพัฒนาคน เสริมสร้างทักษะทางภาษาอังกฤษให้กับเจ้าหน้าที่เทคนิค/ผู้ปฏิบัติ การสร้างความตระหนักรู้เกี่ยวกับกฎระเบียบใหม่ ๆ ของอียู เช่น กฎหมายลดการทำลายป่า มาตรการปรับคาร์บอนก่อนข้ามพรมแดน การติดตามท่าทีอียูต่อสถานการณ์ทางการเมืองและสิทธิมนุษยชนในไทย และเน้นสานสัมพันธ์กับประเทศสมาชิกอียูที่สำคัญหรือที่ให้ความสำคัญกับไทย เพื่อนำร่าง PCA ไทย-อียู ไปสู่การปฏิบัติ สองฝ่ายจะจัดตั้งคณะกรรมการร่วม (Joint Committee) เพื่อขับเคลื่อนความร่วมมือ โดยหน่วยงานอาจเริ่มวางแผนงานได้ล่วงหน้า

Thai-EU PCA Stakeholders Seminar on Fundamental Values and Cooperation under the PCA (8 March 2023)

          On 8 March 2023, the Department of European Affairs, MFA Thailand, and the International Studies Center (ISC) co-organised a stakeholders seminar on the topic of “Fundamental Values and Cooperation under the Thailand-EU Comprehensive Partnership and Cooperation Agreement (TH-EU PCA)”. The event was attended by around 70 participants from 30 organisations across the government, legislative, private and civil society sectors. The panelists hailed from various agencies, such as the Senate Committee for Foreign Affairs (Vice President), Chulalongkorn University (IR lecturer), the Department of European Affairs, the Friedrich-Naumann-Stiftung Foundation (Manager), as well as the Office of the National Security Council and the Ministry of Justice. The Director of the International Studies Center served as moderator.

          Mr. Asi Mamanee, the Thai MFA’s Director-General for European Affairs, opened the event by reiterating the importance of the fundamental values laid out in the Thai-EU PCA in laying down the foundations for advancing cooperation with the EU, which will benefit Thailand on all fronts. The Director-General also took this opportunity to launch the new website tab on the Department’s website https://europetouch.mfa.go.th, which provides information on the PCA and space for the public to express their views on it.

           Seminar participants recognised that upholding values such as democracy, human rights and fundamental freedoms as well as the rule of law, as stipulated in the Thai-EU PCA, will be key to unlocking further cooperation with the EU in other areas. In addition, those principles and values as underscored in EU treaties and declarations form the bedrock of EU foreign policy; and as the EU promotes those values among its partners, the values become part of the international standard.

          The panel addressed the fast-changing global context, and how deglobalisation and the trend towards economic decoupling are pushing the EU to strengthen relations with like-minded partners. The PCA is one such tool for the EU to do so. For Thailand, negotiating a PCA with the EU is seen as a good strategic move; and Thailand was able to negotiate with the EU on an equal footing and within the bounds of Thai law and Thailand’s international obligations and commitments. The PCA will also help to expand Thailand’s policy options.

          As regards implementation of the PCA, many panelists pointed out the opportunity for Thai authorities to learn about new issues such as ocean governance and digitalisation, and new technologies, for instance in the arms-related field. The PCA will also help Thailand gain insight into the EU’s comprehensive and interdisciplinary approach to the issues of the day. The establishment of a human rights dialogue between Thailand and the EU will institutionalise communication in this area and allow the EU to better understand Thailand and the Thai context. At the same time, Thailand can also learn more from the EU and its Member States on developments and challenges they face in the area of human rights and the approaches taken to address them. Cooperation on training and awareness-raising activities regarding business and human rights will help to raise the competitiveness of Thai SMEs in the global market.

           Seminar participants also exchanged views on the challenges of cooperation with the EU, from Thailand’s standpoint. For example, language continues to be a barrier, especially at the level of technical experts. Human resource development, therefore, is a priority. The Thai authorities also need to keep up to date on new EU rules and regulations.

            To implement the Thai-EU PCA, both sides will set up a Joint Committee to drive forward cooperation. To prepare for this, all line agencies and concerned sectors are encouraged to begin formulating and refining their own plans of action to take forward cooperation with the EU in this “new” phase of relations.
